What is a US Money Transmitter License?

 

A US Money Transmitter License is a state-issued authorisation that permits a business to conduct regulated money transmission activities in that state. There is no single federal Money Transmitter License covering the entire United States.

​

FinCEN MSB registration is a separate federal anti-money laundering registration and does not replace state money transmitter licensing. Businesses intending to operate across multiple states therefore need to determine their licensing requirements state by state and build the appropriate multi-state licensing programme.

Key information and requirements for the MTL licence in the US

Key requirements

US Money Transmitter License Requirements

US money transmission regulation operates at both federal and state level, but the two regimes serve different purposes.

​

Federal level: A qualifying money services business must register with FinCEN under the Bank Secrecy Act. FinCEN registration is an AML registration and does not itself authorise money transmission in individual states.

​

State level: Money transmitter licenses are issued by individual state regulators. Whether a license is required depends on the firm's activities, customers, structure and the law and exemptions applicable in each state.

​

Businesses seeking broad US coverage therefore typically require a multi-state licensing strategy, rather than one nationwide license. Many state applications are managed through NMLS, although each regulator determines its own licensing requirements.
